In Pennsylvania, poker game has been declared as a game of skill rather than being the game of luck. A case which was filed against a small-stakes game organized recently was dismissed because the judge declared the game to be something related to skill.
The judgmental decision was declared by Thomas James, the Columbia County Judge, stating “The Court finds that Texas hold’em poker is a game where skill predominates over chance.Thus, is it not ‘unlawful gambling’ under the Pennsylvania Code.”
However, this particular ruling of the court only applies to Columbia and Montour counties, which works under the legal authority of Judge James.
The case primarily was filed versus two people for unlawful gaming for organizing a $1 to $2 no limit holdem game in their home garage. It should be noted that this game was organized without any rake at all; however, the game was characterized by permitted tips to the dealer.
The State Police explored the facts filed in the case by sending officers in disguise for nearly 20 times when the games were organized.
The legal representative for the charged defendants, declared “I’ve come across poker players of different calibers; there’s no doubt in my mind where skill control poker more than just the luck of the draw.”
Also another famous executive director of a famous reporting media stated, “The judge in this specific case have declared a properly investigated decision which supported arguments about poker being a skill game related to predominant skill.”
Though this decision did not have a legal model outside the boundaries of the two rural counties in Pennsylvania, it is a notable victory in the bubbling battle of arguments relating to poker being a game of skill or a game of luck.
This victory for poker is potentially a stepping stone to future legalization of poker in many states where poker playing is not permitted.
